GovFlare is a federal contract intelligence platform that provides access to government contract opportunity data sourced from publicly available government databases, including SAM.gov. The Service includes, but is not limited to:
- Search and discovery of federal contract opportunities including solicitations, presolicitations, sources sought notices, special notices, and awards
- AI-generated summaries, requirements extraction, eligibility analysis, keyword tagging, NAICS code suggestions, and estimated contract value assessments
- AI-powered natural language search and semantic search capabilities
- AI-generated attachment summaries and document analysis
- Advanced filtering by agency, NAICS code, set-aside type, contract type, status, and other criteria
- Agency, sub-agency, and office directory pages with contact information
- Contact directory pages for government contracting officers
- Saved items, pipeline/CRM boards, and notification capabilities for registered users
- LLM-readable endpoints (llms.txt) for machine consumption

3.6 Agency and Organization Data
Agency, sub-agency, and office information displayed on the Service is derived from publicly available government data and may not reflect current organizational structures, name changes, mergers, or reorganizations. GovFlare makes no representations about the accuracy or completeness of agency hierarchy data.
4. User Accounts
To access certain features of the Service, you may be required to create an account. When you create an account, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password or authentication method that you use to access the Service and for any activities or actions under your account, whether your password is with our Service or a third-party service (such as Google OAuth). You agree not to disclose your credentials to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
We reserve the right to disable any user account at any time, for any reason, at our sole discretion, including if we believe you have violated these Terms.
5. Free and Paid Services
5.1 Free Tier
Free users may access a limited number of content detail pages per month. The specific limits of the free tier are subject to change at any time without notice.
5.2 Subscriptions
Paid subscriptions ("Pro") are billed on a recurring monthly basis through Stripe. By subscribing, you authorize GovFlare to charge your payment method on a recurring basis for the subscription fee plus any applicable taxes.
5.3 No Refunds
Subscription fees are billed in advance and are generally non-refundable. There are no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. Refund requests may be submitted to support@govflare.com within 14 days of a charge and will be evaluated at our sole discretion.
5.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting support@govflare.com. Upon cancellation, your paid access will continue until the end of your current billing period, after which your account will revert to the free tier.
5.5 Price Changes
GovFlare reserves the right to adjust pricing at any time. Price changes take effect at the start of the next billing period. We will attempt to provide reasonable notice of material price changes.
5.6 Service Availability
Paid subscriptions do not guarantee uninterrupted access to the Service. The Service may experience downtime, maintenance periods, or outages. We do not provide service level agreements (SLAs) or uptime guarantees. No credits or refunds will be issued for service interruptions.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
- Scrape, crawl, or use automated means to access the Service or extract data in bulk without our express written permission
- Attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service
- Use the Service to transmit any worms, viruses, or any code of a destructive nature
- Impersonate or attempt to impersonate GovFlare, a GovFlare employee, another user, or any other person or entity
- Use the Service to send unsolicited communications, promotions, advertisements, or spam
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
- Use the Service to compete directly with GovFlare or to build a similar or competitive product or service
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
- Remove, alter, or obscure any proprietary notices on the Service
- Share your account credentials with third parties or allow multiple individuals to use a single account
- Resell, redistribute, or sublicense access to the Service without our express written consent
- Use the Service's API endpoints, LLM-readable feeds, or data exports to create derivative products or services without our express written consent
- Systematically download, store, or redistribute data from the Service
- Use the Service in any manner that could damage, disable, overburden, or impair the Service
7. Intellectual Property
The Service and its original content (excluding data sourced from government databases), features, functionality, design, code, AI models, and analytical methodologies are and will remain the exclusive property of GovFlare and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Federal contract opportunity data sourced from SAM.gov is in the public domain. However, our unique presentation, organization, AI-generated analysis, user interface, and value-added features applied to this data are proprietary to GovFlare and may not be copied, reproduced, or distributed without our express written consent.
8. Third-Party Services
The Service integrates with and relies upon third-party services including but not limited to SAM.gov (data source), Stripe (payments), Google (authentication), Cloudflare (hosting), Mailgun (email), and various AI model providers (content generation). GovFlare has no control over and assumes no responsibility for the availability, accuracy, content, privacy policies, or practices of any third-party services.
GovFlare shall not be responsible or liable for any damage, loss, or inconvenience caused by the unavailability, malfunction, or changes to any third-party service, including but not limited to SAM.gov data feed interruptions, Stripe payment processing issues, or AI model provider outages or changes in AI model behavior.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, OR COURSE OF PERFORMANCE.
GOVFLARE, ITS AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT:
- THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
- ANY ERRORS OR DEFECTS WILL BE CORRECTED
- THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- THE RESULTS OF USING THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, WILL MEET YOUR REQUIREMENTS OR BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT
- ANY DATA, INCLUDING OPPORTUNITY DETAILS, DEADLINES, CONTACT INFORMATION, AGENCY DATA, OR CONTRACT VALUES, IS ACCURATE OR UP TO DATE

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOVFLARE, ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- LOSS OF PROFITS, REVENUE, BUSINESS, OR ANTICIPATED SAVINGS

THESE LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF GOVFLARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL GOVFLARE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE EXCEED THE LESSER OF: (A) THE AMOUNT ACTUALLY PAID BY YOU TO GOVFLARE DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Assumption of Risk
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- You assume all risk associated with your use of the Service and any information obtained through it

- Government data sources may contain errors, and GovFlare's processing may introduce additional errors
13. Indemnification
You agree to defend, indemnify, and hold harmless GovFlare and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorney's fees and court costs) arising from or related to:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right
- Any claim that your use of the Service caused damage to a third party
- Any decisions you made based on information obtained through the Service
- Any proposals, bids, or contracts you submitted or entered into based on information from the Service
- Your failure to independently verify information obtained through the Service
This indemnification obligation will survive the termination of these Terms and your use of the Service.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by discontinuing use of the Service, deleting your account through account settings, or contacting support@govflare.com.
All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation: Sections 3 (Critical Disclaimers), 7 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Assumption of Risk), 13 (Indemnification), 15 (Governing Law), and 16 (Dispute Resolution).
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware for the resolution of any disputes.
16. Dispute Resolution
16.1 Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
16.2 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against GovFlare. If for any reason a claim proceeds in court rather than in arbitration, YOU WAIVE ANY RIGHT TO A JURY TRIAL.
16.3 Time Limitation
You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
17. Force Majeure
GovFlare shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government actions, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of third-party services (including SAM.gov, cloud providers, AI model providers, or payment processors), cyberattacks, or any other event beyond our reasonable control.
18. No Government Affiliation
GovFlare is a private company and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with the U.S. General Services Administration (GSA), SAM.gov, the U.S. federal government, or any government agency. Any references to government agencies, programs, or data are for informational purposes only and do not imply any official relationship or endorsement.
19. Modifications to Service
GovFlare reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. Features, data coverage, AI capabilities, and service limits may change at any time.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be modified to the minimum extent necessary to make them enforceable, or if modification is not possible, shall be severed without affecting the remaining provisions.
21. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by GovFlare on the Service, constitute the entire agreement between you and GovFlare concerning the Service and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
